KUZUBAĞ TARIM SAN. ve TİC. A.Ş. INFORMATION NOTICE UNDER LAW NO. 6698 ON THE PROTECTION OF PERSONAL DATA
GENERAL INFORMATION ABOUT THE LAW
Law No. 6698 on the Protection of Personal Data was adopted on 24 March 2016 and published in the Official Gazette dated 7 April 2016 and numbered 29677. Pursuant to Article 32 of Law No. 6698 titled “Entry into Force”, Articles 8, 9, 11, 13, 14, 15, 16, 17 and 18 of this Law entered into force six months after the publication date, as of 7 October 2016.
Law No. 6698 on the Protection of Personal Data has been enacted in order to protect the fundamental rights and freedoms of individuals—primarily the right to privacy—in the processing of personal data, and to regulate the obligations of natural and legal persons who process personal data, along with the procedures and principles they must comply with.
DATA CONTROLLER INFORMATION
Due to your visit to our website and production facility and the transactions you perform via the website, you may share your personal data with us. The personal data you provide and that we record during your visit to our website and production facility are protected with the utmost care and diligence and processed in accordance with the data security rules in force.
As KUZUBAĞ TARIM SAN. ve TİC. A.Ş., your personal data will be used in compliance with the relevant legislation in our capacity as the data controller pursuant to “Law No. 6698 on the Protection of Personal Data”.
- Identity of the Data Controller:
In Article 3/1 (ı) of the Law, the data controller is defined as “the natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system.” Article 10/1 (a) of the Law titled “Obligation of the Data Controller to Inform” also imposes an obligation to inform the data subject about the identity of the data controller.
KUZUBAĞ may have the status of “data controller” within the scope of the Law due to the personal data you share with us via this website and other channels. In this framework, the “identity of the data controller” is KUZUBAĞ TARIM SAN. ve TİC. A.Ş., a joint-stock company incorporated in accordance with the laws of the Republic of Türkiye, registered with the Istanbul Trade Registry Office under registration number 259441-5, with MERSIS number 060209508630001, having its registered address at Ayazağa Mahallesi, Cendere Caddesi No:109B, Vadistanbul Bulvar 1B-Blok, Floor:20, No:46, 34296 Sarıyer/İstanbul, Türkiye.
- Purposes of Processing Personal Data:
Your personal data are processed based on one or more of the conditions for processing personal data set forth in Article 5 of the Law, in accordance with the principles stated in Article 4 of the Law. In all personal data processing activities carried out by KUZUBAĞ, we act in compliance with the Law and all other relevant legislation.
Within the scope of the conditions and purposes for processing personal data specified in Articles 5 and 6 of the Law, the purposes of processing your personal data are: carrying out the necessary work to enable you to benefit from the products and services offered by our Company; improving, developing, diversifying and customizing the products and services offered by our Company in line with consumers’ preferences, usage habits and needs; ensuring the legal and commercial security of our Company and persons having a business relationship with our Company; conducting necessary quality and standards audits; and determining and implementing our Company’s commercial and business strategies.
- To Whom and For What Purposes Processed Personal Data May Be Transferred:
Your collected personal data are processed in accordance with the principles of lawfulness and fairness, accuracy and being up to date where necessary, being processed for specific, explicit and legitimate purposes, being relevant, limited and proportionate to the purposes for which they are processed, and being retained for the period stipulated in the relevant legislation or required for the purpose for which they are processed. In addition, provided that the conditions stipulated in Articles 8 and 9 of the Law are complied with and necessary security measures are taken, your personal data may be transferred—limited to the purposes listed under item (b) of this notice—to our direct/indirect affiliates or subsidiaries; public/private institutions and organizations, companies and other third parties or entities from which we receive services/support/consultancy, with which we cooperate, or with which we have project/financing partnerships; our affiliated companies, consultants, shareholders or solution partners and other group companies; the Central Securities Depository Institution (Merkezi Kayıt Kuruluşu) and other authorized institutions and organizations; our suppliers or subcontractors. KUZUBAĞ may process and store your personal data on servers or in other electronic environments, provided that the necessary security measures are taken.
- Method and Legal Basis for Collecting Your Personal Data:
Your personal data are collected by our Company, KUZUBAĞ, through various channels and in compliance with the laws, including but not limited to the records you create through the use of this website for the purpose of conducting our commercial activities; all kinds of information forms, surveys, job application forms, employment contracts, social media applications, and contracts you have concluded with our Company. Your personal data may also be processed and transferred for the purposes stated in this Information Notice within the scope of the conditions and purposes for processing personal data specified in Articles 5 and 6 of the Law.
- Rights of the Data Subject:
As data subjects, you may submit your requests regarding your rights to us through the methods set out in the “KUZUBAĞ TARIM SAN. ve TİC. A.Ş. Policy on the Processing and Protection of Personal Data” published at https://www.kuzubag.com . KUZUBAĞ will finalize your request as soon as possible and, in any case, within thirty (30) days, free of charge, depending on the nature of the request. If providing the information you request regarding your personal data requires an additional cost, such information will be provided on condition that the fee in the tariff determined by the Personal Data Protection Board is paid. The rights of natural persons whose personal data are processed under Article 11 of the Law are as follows:
- To learn whether personal data are processed,
- To request information if personal data have been processed,
- To learn the purpose of processing personal data and whether they are used in accordance with that purpose,
- To know the third parties to whom personal data are transferred domestically or abroad,
- To request the correction of personal data if they are processed incompletely or inaccurately, and to request that the transaction made within this scope be notified to the third parties to whom the personal data have been transferred,
- To request the deletion or destruction of personal data in case the reasons requiring processing cease to exist, even though they have been processed in accordance with the Law and other relevant laws, and to request that the transaction made within this scope be notified to the third parties to whom the personal data have been transferred,
- To object to the occurrence of a result against the person by analyzing the processed data exclusively through automated systems,
- To request compensation for damages in case of loss due to unlawful processing of personal data.
Pursuant to paragraph 1 of Article 13 of the Law, you may submit your request regarding the exercise of your rights stated above to our Company in writing. By completing the attached (ANNEX) form and signing it with a wet signature, you may deliver one signed copy in person to KUZUBAĞ together with documents proving your identity at the address Ayazağa Mahallesi, Cendere Caddesi No:109B, Vadistanbul Bulvar 1B-Blok, Floor:20, No:46, 34296 Sarıyer/İstanbul, Türkiye, or send it via a notary public. Our Company reserves the right to amend this information notice due to possible amendments to the Law and the methods to be determined by the Personal Data Protection Board.
